Virginia Whipple, the plaintiff in error, who will hereinafter be referred to as the plaintiff, instituted a proceeding by notice of motion for judgment against Gordon Booth, defendant in error, who will hereinafter be referred to as the defendant, for $2,000.00 damages, which the plaintiff is alleged to have sustained through an automobile collision which occurred on one of the streets of the town of Bedford.

The trial resulted in a verdict for the plaintiff for $750.00. The defendant moved to set the verdict aside and enter final judgment for him on the ground that the verdict was contrary…
