WELBORN, Commissioner.

A jury found Richard P. Van Regen-morter guilty of possession of marijuana and fixed his punishment at ten years’ imprisonment. The defendant appealed from the ensuing sentence and judgment.

On July 15, 1969, Special Agent Clark of the Federal Bureau of Narcotics, telephoned appellant at the Post Hospital at Fort Leonard Wood. Appellant was a member of the United States Army, stationed at Fort Leonard Wood. Clark, using the code name “Oasis,” inquired about the purchase of marijuana.
