The plaintiff, Lincoln G. Latham (“Latham”), sued Homecomings Financial LLC f/k/a Homecomings Financial Network, Inc. (“Homecomings”) and Value One Mortgage (“Value One”) alleging that they engaged in a “bait and switch” scheme under which Latham was fraudulently induced to execute an adjustable rate note secured by a mortgage on his principal residence. Count IV of Latham’s complaint alleges that Homecomings violated Chapter 93A by failing to negotiate with him in good faith to avoid foreclosure.
