Cross appeals from a judgment of the Supreme Court (O’Brien, III, J.), entered January 14, 1999 in Madison County, which, inter alia, denied defendant’s motion and plaintiffs’ cross motion for summary judgment.
Plaintiff Brenda Rath (hereinafter plaintiff) was injured when the vehicle she was driving, owned by her husband, was rear-ended by a car driven by defendant.
