OPINION OF THE COURT
Spain, J.
Plaintiff commenced this action to recover damages for personal injuries she allegedly sustained in an October 1997 motor vehicle accident in the City of Albany, Albany County. According to plaintiff, she was operating an automobile stopped at a traffic light when a recycling truck in front of her car, driven by defendant Mark N. Dupuis and owned by defendant City of Albany, began moving in reverse and collided with the front of her car, causing her to move about within the passenger compartment and strike the back of her seat and the steering wheel.
