Appeal from an order of the Supreme Court (Ryan, Jr., J.), entered October 1, 1996 in Clinton County, which denied defendants’ motion for summary judgment dismissing the complaint and granted plaintiffs cross motion for summary judgment on the issue of liability.

Plaintiff sustained the injuries forming the basis for this negligence action in a February 1, 1993 automobile accident.
