This is an appeal by the plaintiff, Donald Bos, from a judgment for the defendant State Industrial Accident Commission in an action brought under the provisions of the Workmen’s Compensation Law. The plaintiff was injured in September 1953 while in the employ of Rueben G. Lenske. He thereafter filed a claim for workmen’s compensation with the Commission. The claim was denied by an order of 25 January 1955 for the reason, as stated by the Commission, that “the claimant Donald Bos, was not injured by accident arising out of and in the course of employment while employed subject to the Workmen’s…
