This appeal is prosecuted for the purpose of bringing up for review the judgment of the trial court rendered upon the verdict of a jury, in an action for damages claimed on account of a breach of a contract. The plaintiff in error assigns the following errors:

“(1) That the court committed error in overruling and denying the demurrer to the petition of the plaintiff. (2) That the verdict of $604.54 is excessive, as $225 is the highest amount that there is any credible evidence to sustain, and the same could only have been given under passion and prejudice.
