On the 21st day of May. 1924, the defendant in error, as plaintiff, brought an action in the district court of Okmulgee county against the plaintiff in error, as defendant, to recover certain illegal taxes alleged to have been paid under protest. Parties will be hereinafter designated as they appeared in the trial court.
There were four causes of action incorporated in plaintiff's petition, but we are concerned in fills appeal only with the merits of the first cause of action, wherein the plaintiff sought a recovery of taxes which he alleged had beoln -illegally levied for…
