This action was brought to determine diverse-waims to $3240 and interest on deposit with the defendant bank.

The coanplaint averred that this deposit consisted of moneys of which ^he deceased, Bartholomew Kennedy, was the sole owner in Bis lifetime and which from time to time he deposited personally .in the defendant bank and that such deposit was at the time of his death a part of his estate; that the defendant Mary E. McMurray asserted a claim to said deposit as her separate property which asserted claim was without right; that-both plaintiff and said defendant Mary E. McMurray had demanded…
