These are two actions of contract arising out of the purchase and sale of ten cars of apples, and the consignment of another car to the buyer to auction for the seller’s account. The buyer was the L. E. Fosgate Company, a corporation and commission merchant of Boston, and the Spokane Valley Growers Union, an incorporated fruit growers’ association of Opportunity, Washington, was the seller. The former is hereafter referred to as “buyer” and the latter as “seller.”
