Centro Medico Del Turabo, Inc. v. Feliciano De Melecio

Court of Appeals for the First Circuit

Decided April 19, 2005No. 04-1967PublishedCited by 462 opinions

1Opinion of the Court

SELYA, Circuit Judge.

In this appeal, the plaintiffs challenge the district court’s dismissal of their complaint, brought under 42 U.S.C. § 1983, for failure to state a claim upon which relief might be granted. After careful consideration of the briefs and the record, we conclude that the most recent incident described in the complaint was not actionable; that the earlier incidents fell outside the limitations period; and, therefore, that the district court properly dismissed the complaint.
