Hilton, Justice.

Plaintiff, a depositor in defendant bank, sued for the amount paid by the bank as drawee on five forged checks charged to plaintiff’s account. The trial court made findings and conclusions favorable to defendant. Thereafter the court ordered a new trial upon the ground that it had erred “in denying plaintiff’s motion for a trial of said action by a jury.” Defendant appeals from that order.

Plaintiff owns and operates the Andrews Hotel in Minneapolis. Its board of directors is composed of seven experienced business and professional men. Four of the directors are also officers,…
