By the judgment in this case the plaintiff recovered from the defendant the sum of $18,576.98 and costs. The defendant recovered a like amount and costs from the intervener. Both the defendant and the intervener appeal. The facts appear to he as follows: For many years prior to September, 1918, the plaintiff had been a depositor of The Farmers and Merchants National Bank, the defendant. At the time the account was opened the treasurer of the plaintiff corporation received a pass-book which contained what purported to be an “Agreement with Depositor,” and which provided in substance that…
