JUDGMENT
BOYLE, Chief United States Magistrate Judge.
The Court has before it a Report and Recommendation filed by the United States Magistrate, Judge Larry M. Boyle. The defendant, the Government, filed an objection to the Report. The Court examined the Report under the de novo standard of review set out in 28 U.S.C. § 636(b)(1)(C). On the basis of that review, the Court shall adopt the Report except its findings that the second and third mitigation provisions were met in this case as set forth in 26 U.S.C. §§ 1311(b)(1)(A) and 1312, respectively.
