In this action for a declaratory judgment [Sections S27.010 to 527.140, inch], plaintiff seeks a determination of rights and status under a written agreement between C. E. and Helen Whartenby, as "lessors,” and Melvin Hall (one of the defendants herein), as “lessee,” dated July 1, 1941, and recorded in the office of the Recorder of Deeds of McDonald County, Missouri, on September 20, 1941.
