HOWARD, Judge.
This appeal involves two lawsuits which were consolidated in the trial court. The pleadings which set forth claims and defenses of all the parties below were numerous and complex. The form in which the various claims were presented in the pleadings is not material and, therefore, no attempt will be made to detail the procedural manner in which the many questions involving this appeal first arose.
