MCI Telecommunications (“MCI”), a long distance telecommunications service provider, has sued Teleconeepts to recover the cost of services MCI provided under MCI’s Federal Communications Commission tariff (“FCC tariff’). Teleconeepts raised the untimely service of the complaint and the statute of limitations as defenses, and also brought a third-party action against Bell of Pennsylvania (“Bell”), Teleconeepts’ local telephone exchange carrier.
