Pending before the Court are the motions for summary judgment filed by Plaintiff Antonio Amador (“Plaintiff’), (Docket No. 53), and Defendant McDonald’s System de Puerto Rico Inc. (“Defendant”). (Docket No. 54 and 56). Both Motions were referred to a Magistrate Judge for a Report and Recommendation. (Docket No. 79). The Magistrate Judge recommended that the motions be granted in part and denied in part. (Docket No. 90).
