This case involves a conviction for DWI, third offense. Mr. James I. Johnson was convicted in municipal court of DWI third offense and appealed that conviction to the Cleburne County Circuit Court. After the trial court concluded that there was no speedy-trial violation, Mr. Johnson waived his right to a jury trial and a bench trial ensued. The trial court denied Mr. Johnson’s request to certify a witness as an expert and denied his motion for dismissal based upon the insufficiency of the evidence.
