MEMORANDUM AND ORDER

JOYNER, District Judge.

This civil rights ease has been brought before the court by motion of the Defendants, Robert Deaver and Robert Smythe to dismiss the plaintiffs amended complaint with prejudice pursuant to Fed.R.Civ.P. 12(b)(6) for failure to state a cause of action under the Civil Rights Act, 42 U.S.C. §§ 1983, 1985(3) and 1986. For the reasons delineated in the paragraphs which follow, the motion is granted in part and denied in part.
