OPINION

PISANO, District Judge.

Subsequent to a competency hearing held on July 26, 2005, this Court found Defendant, Kevin McCray, to be suffering from a mental disease or defect rendering him incompetent to stand trial on the criminal charges against him. The Court ordered that Defendant be hospitalized in order to determine whether there existed a substantial probability that Defendant would be restored to competency in the foreseeable future.
