MEMORANDUM OPINION
DE MENT, District Judge.
Before the court is plaintiff Clark Construction Company, Inc.’s motion for sum mary judgment filed August 25, 1995. The defendants responded in opposition on September 18, 1995. The director of the Alabama Department of Transportation, Jimmy F. Butts, also filed a motion for summary judgment on September 18, 1995.
