MEMORANDUM AND ORDER

GLASSER, District Judge:

Shortly after he pled guilty to second degree attempted manslaughter in Nassau County Court, plaintiff Barry Furst was dismissed by his employer, defendant New York City Transit Authority (NYCTA). Following his dismissal, the plaintiff instituted this action for reinstatement under 42 U.S.C. § 1983 and now moves for summary judgment against the NYCTA contending that he lost his job pursuant to the defendant’s unconstitutional policy of dismissing all employees convicted of committing felonies.
