Defendant was convicted of assault by means of force likely to produce great bodily injury. (Pen. Code, § 245.) He appeals from the ensuing judgment.

Defendant and the victim, William R. Kallian, were partners in the auto parking business in Los Angeles. This offense occurred at about 8 p.m. on August 6, 1952, in a parking lot near Mr. Kallian’s residence. He had just parked his car and was about two or three car lengths away when he first saw the defendant secreted between two automobiles in a crouching position. The defendant stated, “I’ve got you now, and I’m going to kill you.” Whereupon…
