This appeal is taken from the judgment of conviction and sentence; the order denying the motion to dismiss under Penal Code, section 995; and the order denying defendant’s motion for a new trial.

By information, the defendant was charged with the following :(1) Possession of a quantity of heroin in violation of Health and Safety Code, section 11500.(2) Transportation of the same quantity of heroin in violation of Health and Safety Code, section 11500.

*123(3) Assault by means of a force likely to produce great bodily injury in violation of Penal Code, section 245.
