EDMONDS, J., pro tem.
tem. — William R. Thompson had judgment against the defendant upon the verdict of a jury. He subsequently died, and his administrator has been substituted as plaintiff. The defendant’s principal contention on appeal is that the evidence is insufficient to sustain the verdict. Error is also predicated upon instructions given and refused.
