Appellant Prescott was treasurer of Spokane county from January 9,1893, until January 14, 1895. Prior to entering upon his official duties, he executed an official bond, which was duly approved by the board of county commissioners. On January 14, 1895, it was his *419-duty, as county treasurer, to pay to his successor in office the sum of $72,837.78. He paid to his successor only $19,631.65.
