A full report of this case appears in 47 S. W. (2d) 452; after fully considering the record and briefs, we conclude that a correct disposition thereof was made by the Court of Civil Appeals.

Writ of error was granted on the application of H. J. Tanner (none of the other parties having applied) on his first assignment of error as follows:
