Defendants-appellants Samuel J. Russot-ti, Rene Piccarreto, Richard J. Marino and Thomas E. Marotta appeal from an order of the United States District Court for the Western District of New York, Michael A. Telesca, J., denying their motions to dismiss an indictment filed November 8, 1982. That indictment charges appellants and six others with violations of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. §§ 1961-1968 (1970), commonly known as RICO.
