This is an action brought by Henry A. Fowler, as administrator of the estate of Thomas Booney, deceased, to recover damages for the killing of said Booney by a passenger train operated by the Chicago & Erie Bailroad Company upon the elevated tracks of the Chicago & Western Indiana Bailroad Company in the city of Chicago. The deceased was seventeen years of age and was a trespasser on the tracks at the time.
