This case is before the court on defendant’s motion for summary judgment, as opposed by plaintiff, after oral argument.

FACTS

The following facts are undisputed. On July 26, 1978, plaintiff United Construction Company, Inc. (“plaintiff”), entered into a construction contract with the Department of the Army Corps of Engineers, Kansas City District (the “Corps”). By letter dated June 25, 1979, plaintiff notified the Corps that additional work was required because construction site conditions were not as the parties had anticipated.
