NICHOLLS, J.

Plaintiff sues to recover from the defendant damages for personal injuries alleged to have been received by him while employed at the Rayon cotton gin, in the town of Rayne, in Acadia, which was at the time leased and operated by the defendant, which injuries he alleged resulted in the loss of his left arm near the shoulder. The injury he averred occurred without any neg-*571ligenee on his part, but through the gross negligence and fault of the defendant.
