MEMORANDUM OPINION

CHARLES R. RICHEY, District Judge.

In this lawsuit, plaintiffs challenge certain procedural and substantive aspects of the federal government’s administration of the federal-aid highway program. Specifically, plaintiffs seek injunctive and declaratory relief to restrain the Secretary of Transportation and the Federal Highway Administrator from implementing § 116 of the Federal-Aid Highway Act of 1973, 23 U.S.C. § 117.
