NEBEKER, Associate Judge:

This is an appeal from a jury verdict for the defendant in a negligence action. The appellant questions the sufficiency of the evidence to sustain a jury finding to the effect that either the defendant was not negligent or that the plaintiff was contribu-torily negligent. Additionally, he asserts that the trial court erred in submitting the issue of contributory negligence to the jury.
