This case was dismissed in the court below upon a demurrer to the plaintiff’s petition, and the bill of exceptions alleges that the court erred in sustaining the demurrer. The demurrer was both general and special. The general ground alleged that the petition set forth no cause of action, and that the plaintiff had an adequate remedy at law. • By way of special demurrer, it was alleged that 'there was a misjoinder of causes of action; and also that there was a misjoinder of parties.
