The plaintiffs bring this action for equitable relief based on the following facts:
In the year 1910 one William H. Showdy, who was the father of. defendant, was the owner of a farm of about twenty-three acres of land in the town of Verona, Oneida county. This property was worth not to exceed $1,000 and said William H. Showdy, who was a man then seventy-four years of age, lived alone upon the farm. He was taken sick with pneumonia and at the defendant’s request the plaintiff Minnie Parmely, *636who is the wife of the other plaintiff, went to his place for the purpose of giving him care and…
