In an information filed by the district attorney of Los Angeles County containing three counts, defendant was accused of violations of. section 337a of the Penal Code. Count I alleged a violation of subdivision 1 in that defendant did unlawfully engage in bookmaking upon the result and purported result of a horse race. Count II charged a violation of subdivision 2 in that the defendant kept and occupied a residence, with books, papers, paraphernalia, etc., for the purpose of recording and registering bets on horse-races.
