Latimer Construction Company, Inc., plaintiffs below, appeal from a judgment of the Circuit Court of Brooke County which upheld a conveyance of real property by the appellee, Martha Latimer Mechling, executrix of the estate of Charles W. La-timer, to the appellee, Mountain Construction and Engineering Company, Inc. (Mountain Construction), assignee of William M.
