This was an information in the name of the 'State, on the relation of Samuel M. Hench, Esq., as plaintiff, in the nature of a proceeding by writ of quo warranto, against Hon. Augustus A. Chapin, acting judge of the superior court of Allen county, as defendant. Appellee Chapin demurred lo the relator’s information, upon the ground that it did not state facts sufficient to constitute a capse of action.
