This action was brought under the Uniform Declaratory Judgments Act, Acts 1927, ch. 81, *40being §3-1101, et seq., Burns’ 1946 Replacement, to determine the right and duties of the Marion County Election Board and the members thereof, as they relate to the election of a Clerk of the Marion Circuit Court, at the general election to be held on November 8, 1960.
Because of the public interest and concern in the determination of this case, and the written request of all parties thereto so to do, it has been advanced on the docket for immediate consideration.
