MEMORANDUM OPINION AND DECISION

LOREN S. DAHL, Bankruptcy Judge. FACTS:

On December 19, 1979, the Department of Veterans Affairs of the State of California entered into a Vendor-Vendee land sales agreement with John E. and Linda S. Bene-field. This agreement of sale was recorded in the Glenn County Recorder’s Office on January 15,1980. On January 25,1980, the Department of Veterans Affairs issued a consent to encumber the property. The Benefields then executed a Note, secured by a Deed of Trust whereby the Debtor, Capitol Mortgage & Loan, is the named beneficiary. Said Deed of Trust was duly…
