MENOR, J.

This is an appeal by the defendant from a circuit court order disqualifying and enjoining him and his deputies from exercising their prosecutorial powers. By letters, dated October 20 and 21, 1976, to the defendant, Maurice Sapienza, then the Prosecuting Attorney of the City and County of Honolulu, the plaintiff, Ronald Y. Amemiya, then acting in his capacity as the Attorney General for the State of Hawaii, had “sought to supersede and set aside the authority of the Defendant to participate in the prosecution of criminal acts relating to the Kukui Plaza Project…
