Rooker v. Fidelity Trust Co.

This appeal is from an order and decree which confirmed a sale theretofore ordered by the court in its final decree which settled the rights of the parties. This proceeding is auxiliary to and in execution of the final decree on the merits.

Appellants made and executed, on October 11, 1909, as first parties, to appellee Fidelity Trust Company, as second party, their certain instrument of trust in writing, and, contemporaneously therewith, executed their deeds of conveyance to appellee Fidelity Trust Company, and delivered the deeds to the grantee and trustee.
