The question that first presents itself. 'is whether the court has jurisdiction of the action. The award of the Industrial Commission was made on the 14th day of June, 1919. This action was brought by the attorney *417general June 20, 1919. It was brought on his own initiative, without authority from the governor. On the 17th day of November, 1919, a motion to dismiss the action was made in the circuit court.
