MOTION FOR JUDGMENT ON THE PLEADINGS
This motion raises the intriguing question whether the negligent parties responsible for the sinking of a vessel can be made responsible for the damage resulting from subsequent collisions with the sunken wreck. In particular, it raises the question of the effect of the Wreck Act, 1 a statute recently described in a Fifth Circuit opinion as “impossibly obscure”, 2 upon an already complicated tortious causation problem.
