This is a suit for declaratory judgment instituted by plaintiff, City of Sugar Creek, against defendant, City of Independence.

Plaintiff is a City of the Fourth Class. Defendant is a city organized under a Constitutional Special Charter. Both cities heretofore undertook to annex common areas and both presumably completed their respective annexations prior to the institution of this litigation.
