OPINION ON MOTION FOR REHEARING

HUTSON-DUNN, Justice.

Appellant has made a motion for en banc consideration of its motion for rehearing. We deny appellant’s motion for rehearing, however we withdraw our original opinion and issue this one in its stead.

In this case, the trial court ruled that the appellant, Harris County Flood Control District (the district), was subject to covenants and restrictions that imposed a lien for unpaid assessment fees upon patiohomes that the district purchased.
