The defendant, James Diggs, was charged in an information with murder in violation of General Statutes § 53a-54a (a).1 He was convicted by a jury of the crime charged and was sentenced by the trial court to a term of imprisonment of forty-six years.

The charge arose out of an incident that occurred shortly after 1 o’clock in the morning on October 2, 1988, in front of 541 Gregory Street, Bridgeport. During an argument, the defendant, then sixteen years old, shot and killed the victim, twenty-six year old Frank Davis, with a single shot from a sawed-off .22 caliber rifle.2 The defendant…
