MEMORANDUM OPINION and ORDER
OSTEEN, District Judge.
Plaintiff Collezione Europa U.S.A., Inc. (“Collezione”) instituted this action against its competitor, Defendant Hillsdale House, Ltd. (“Hillsdale”) on September 7, 2001. Collezione seeks a declaratory judgment determining that its marketing and sale of certain items of furniture does not infringe or violate any of Hillsdale’s rights. Hills-dale has filed a counterclaim alleging that Collezione’s marketing and sale of the furniture does violate Hillsdale’s rights under the Copyright Act, 17 U.S.C. § 101 et seq., and also asserting claims for…
